On July 27th, a Chinese lab will upload a model to the internet that performs as well as the most expensive model you can currently buy. For free. Six days later, on August 2nd, any unlabeled chatbot on your website will become a punishable offense with a fine of up to €35 million.
Two dates. Thirteen days away, and in most German boardrooms, neither of them is currently on the calendar.

July 27th: When peak performance becomes available for download
Moonshot AI released Kimi K3 on the night of July 17th. It's a mixture-of-experts system with 2.8 trillion parameters, one million token context windows, and native image processing. The price: $3 per million input tokens, $15 for output. Early evaluations by Artificial Analysis place the model in the performance class of GPT-5.5 and Claude Opus 4.8.
The actual date, however, is not the 17th, but the 27th of July. That's when the weights will be publicly released. The largest open-track model ever released.
In other words: Any company with sufficient computing power will soon be able to run a Frontier model in its own data center. No API contract. No data leaks. No paying a single dollar to a Western lab.
This is not a press release. This is a download.
The markets are calculating.
The Nasdaq fell 1.4 percent this week, the Philadelphia Semiconductor Index 1.6 percent. Not a crash, but a clear signal. Kimi K3 was one of several triggers in a sell-off that finally puts a long-standing question into concrete terms.
If an open model delivers most of the performance at a fraction of the price, how can investments in hundreds of billions of dollars in closed infrastructure be justified?
For you as a decision-maker, this isn't a stock market issue. It's a procurement issue. Anyone negotiating multi-year contracts with frontier suppliers today is negotiating against a price curve that is currently plummeting.

Shanghai: An AI world order is emerging without Europe
On July 17, Xi Jinping personally opened the World Artificial Intelligence Conference , the first time since the event's inception in 2018. He positioned China as a cooperative partner of developing countries. On the same day , 29 nations signed the founding agreement of the World Artificial Intelligence Cooperation Organization, headquartered in China.
The figures behind this are already a reality. Chinese providers handle around 45 percent of all traffic on OpenRouter. A year ago, it was less than 2 percent.
For European companies, this becomes a very concrete question: Who operates my inference, in which jurisdiction, under which law? Chinese models present three gaps that must be checked before any go-live: content restrictions on politically sensitive topics, data jurisdiction because API calls run via Chinese servers, and deviations in tool call schemes.

August 2nd: Article 50 knows no postponement
While the Digital Omnibus has postponed the high-risk obligations to the end of 2027, one date remains unchanged: August 2, 2026. On that date, the transparency obligations under Article 50 of the EU AI Act will become fully applicable.
What this specifically requires:
Providers and operators of AI systems must inform users when they are communicating with a machine. Synthetic content must be clearly marked as AI-generated in a machine-readable manner. This applies to every chatbot on a website, every voicebot in a service, and every AI-generated communication.
The AI Act's penalty framework extends up to €35 million or 7 percent of global annual turnover . And the deadline applies immediately, without any national implementing legislation.
Important for understanding roles: Most companies are operators, not providers. They purchase an AI tool and use it in customer interactions. This doesn't absolve them of responsibility; it obligates them to transparently disclose its use.
The Federal Office for Information Security (BSI) has at least reacted and published the joint draft of its AI audit and assurance assessment architecture A5. A testing framework is emerging. However, it is being developed concurrently with the deadline, not before.
56 against 91: The most dangerous number combination of the year
A TÜV study shows that 56 percent of German companies see a significant need to catch up in the implementation of legal requirements.
A GitLab study shows that 91 percent of the companies surveyed already use at least two AI tools.

Why the bottleneck was never the model
